The operator (the “Operator”) of MELBSKY.COM (Melbourne Sky, the “Site”) manages users’ personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (“APPs”). This Policy explains what personal information we collect, why and how we collect, use, hold and disclose it, and how you can access or correct your information or make a complaint.
1. Kinds of personal information we collect
- When you register: user ID, nickname, email address and password (stored only in a non-reversible encrypted form).
- When you post: the content of your posts and comments, uploaded photos and images, and information you enter yourself (such as area, price, business address or contact details). For non-members: author name and an edit/delete password (stored encrypted).
- When you contact us, report content or subscribe to updates: name, email address and the content of your message.
- Collected automatically: IP address, date and time of access, browser and device information, pages visited, cookies and session information.
- Migrated from the previous website: user IDs, nicknames, email addresses, encrypted passwords and posts of members of the previous Melbourne Sky website (to continue providing services on the new Site).
We do not intentionally collect sensitive information such as racial origin, religion, health or political opinions. Information you choose to publish in a post is visible to other users, so please take care when posting personal contact details such as mobile numbers or addresses.
2. How we collect personal information
We collect personal information directly from you when you register, post or use our forms, and automatically through server logs and cookies while you use the Site. Wherever practicable, we collect personal information directly from you.
3. Purposes of collection and use
- identifying members, login and account management;
- providing the boards, jobs, share/rent, marketplace, business directory and other Services;
- automatic translation of posts and display optimisation (automatic image resizing);
- preventing spam, fraud and misuse, and maintaining security and service stability;
- responding to enquiries, reports and infringement requests;
- analysing visit statistics and improving the Services;
- displaying advertising to fund the operation of the Site;
- sending Site news where you have asked to receive it.
4. Anonymity and pseudonymity
You can read posts without registering, use a nickname (pseudonym), and post on some boards as a non-member. However, anonymity may not be possible for member-only features, paid services or handling infringement complaints where we need to verify identity.
5. Disclosure of personal information
We do not sell your personal information. Personal information may be disclosed or made available in the following cases:
- information you choose to publish in a post (public posts can be seen by anyone and may appear in search engines);
- service providers we use to operate the Site: web hosting and server providers, email services, translation services (Microsoft Azure Translator — only post titles and content are sent), and advertising and analytics services (Google);
- where required or authorised by law, or where requested through lawful process by law enforcement, courts, the eSafety Commissioner or other government agencies;
- where necessary to protect the life or safety of you or others, or to prevent fraud or other unlawful activity.
6. Overseas disclosure (APP 8)
Some services used to operate the Site have servers outside Australia, so your personal information may be processed or stored overseas. These countries may include the United States (e.g. Google, Microsoft) and hosting or cloud data centres outside Australia (e.g. in the Asia-Pacific region such as Singapore). We take reasonable steps to choose reputable providers and to provide only the information that is necessary.
7. Cookies and advertising
- The Site uses essential cookies for keeping you logged in, security (CSRF protection) and language settings.
- The Site displays advertising through Google AdSense. Third-party vendors, including Google, use cookies to serve ads based on your prior visits to this Site or other websites.
- Google’s use of advertising cookies enables it and its partners to serve ads based on your visits to this and other sites. You can opt out of personalised advertising in Google Ads Settings (adssettings.google.com), and opt out of other third-party vendors’ cookies for personalised advertising at www.aboutads.info.
- We may use Google Analytics for visit statistics. You can opt out by installing the Google Analytics opt-out browser add-on.
- You can refuse or delete cookies in your browser settings, but some features such as login may not work properly.
8. Storage and security
- Passwords are stored using non-reversible encryption, and the whole Site uses a secure connection (HTTPS).
- Administrative functions are accessible only to authorised administrators, and key administrative actions are logged.
- We keep personal information only for as long as needed for the purposes for which it was collected. When a member closes their account or requests deletion, information we are not required by law to keep is deleted or de-identified within a reasonable time. Security logs such as access records are kept for a limited period to prevent misuse and then deleted.
- If a data breach is likely to result in serious harm, we will notify affected individuals and, where required, the Office of the Australian Information Commissioner (OAIC) under the Notifiable Data Breaches scheme, and take steps to minimise harm.
9. Access and correction (APPs 12 and 13)
You may request access to, correction of or deletion of the personal information we hold about you. Please email us at the address below; after verifying your identity, we will respond within a reasonable period (usually within 30 days). Access and correction are free of charge. If we refuse a request on grounds permitted by law, we will tell you why in writing (by email).
10. Automated processing and translation
The Site uses machine (automatic) translation to display posts in other languages and runs automated filters to prevent spam. We do not make decisions that significantly affect your rights or interests solely by computer program. If this changes, we will update this Policy.
11. Email updates (Spam Act 2003)
We send Site news by email only if you have asked to receive it. Every message identifies the sender and includes a way to unsubscribe, and you can unsubscribe at any time.
12. Children’s personal information
Registration is available only to people aged 16 or over, and we do not knowingly collect personal information from children under 16. If we become aware that we have collected information from a child under 16, we will delete it promptly. Parents or guardians can contact us at the email address below.
13. Complaints
If you have a complaint about how we handle your personal information, please email the details to the address below. We will review your complaint and respond within a reasonable period (usually within 30 days). If you are not satisfied with our response, you may complain to the Office of the Australian Information Commissioner (OAIC). Website: www.oaic.gov.au
14. Changes to this Policy
We may update this Policy to reflect changes in the law or our Services, and will publish the effective date and changes on the Site. This Policy is available free of charge on the Site at any time, and you may request a copy in another form (for example, by email).
